General Terms and Conditions (GTC) – Guest Accommodation Terms and Conditions for Accommodation Services

Dear Guest,

We kindly ask you to read the following terms and conditions carefully. They govern the legal relationship between you and our accommodation provider, The Glamping Resort Olive & Sea j.d.o.o., Put Vodica 35 A, 22212 Tribunje (hereinafter referred to as the “Accommodation Provider”).

The contract for the booked service is concluded exclusively between you and the accommodation provider. Any deviating agreements that change the scope of the contractual service must be confirmed.

Booking and conclusion of contract

  1. Bookings can be made electronically via the Internet, by post, by fax, in writing or by telephone.
  2. With your booking, you submit a binding offer to the accommodation provider to conclude an accommodation contract subject to these guest admission conditions.
  3. The aforementioned contracts are concluded upon acceptance by the accommodation provider. Acceptance does not require any particular form and is made immediately after conclusion of the contract by sending a booking confirmation. In the case of an electronic booking via the Internet, you will receive a booking confirmation by e-mail at the end of the booking process. You have the option of printing this booking confirmation.
  4. The data provided by you will be protected in accordance with the statutory provisions.

 

Payment

  1. Unless expressly agreed otherwise, payment of the accommodation price shall be made ihnenectly to the accommodation provider in accordance with the booking confirmation.
  2. For bookings made at least 14 days before the start of the stay, a deposit of 20% of the total price must be paid to the accommodation provider within 7 days of conclusion of the contract (receipt of the booking confirmation in verbal, written or electronic form). The balance is to be paid to the accommodation provider no later than 14 days before arrival, unless other payment terms are specified in the booking confirmation.
  3. For bookings made less than 14 days before the start of the stay, the total price must be paid immediately after conclusion of the contract or as agreed with the accommodation provider.

 

Withdrawal / Cancellation

  1. You may withdraw from the contract concluded with the accommodation provider at any time. The cancellation should be declared stating the booking number.Decisive is the receipt of the cancellation notice by the accommodation provider. We recommend that you declare your cancellation in writing.
  2. If you withdraw from the concluded contract or do not make use of the booked accommodation, the accommodation provider may demand the agreed price less expenses saved and income from renting the accommodation to other parties.
  3. The following percentages apply to the calculation of saved expenses in accordance with case law:
  • For holiday apartments/accommodation without meals: 90%
  • For bed and breakfast: 80%
  • For half board: 70%
  • For full board: 60% The above percentages refer to the total price of the accommodation services (including all additional costs), but excluding any public charges such as tourist tax or guest contribution.
  1. In any case, you are free to prove that no damage or significantly less damage than the lump sum demanded by you was caused by your cancellation. In this case, you are obliged to pay the lower costs (or no payment if no loss has been incurred).
  2. We strongly recommend that you take out travel cancellation insurance.

 

Obligations of the contractual partner

  1. Claims due to non-contractual provision of services must be asserted immediately and exclusively against the respective accommodation provider.
  2. You are obliged to notify the accommodation provider immediately of any defects in the accommodation service or other contractual services or to demand remedy.
  3. The notification of defects must be addressed exclusively to the accommodation provider.
  4. The accommodation may only be occupied by the agreed number of persons. Over-occupancy may result in the accommodation provider cancelling the contract without notice or demanding reasonable additional payment.
  5. Pets of any kind may only be brought into the accommodation by express agreement with the accommodation provider, taking into account the information on the type and size of the animal.

 

Obligations of the accommodation provider

  1. The accommodation provider is obliged to provide the agreed services to an extent that corresponds to its standard
  2. Special services of the accommodation provider that are subject to labelling and are not included in the accommodation fee shall be listed separately

 

Arrival and departure times

  1. Unless otherwise agreed, the booked accommodation is available from 16:00 on the day of arrival.
  2. If you arrive after this time, you are obliged to inform the accommodation provider in good time. If you fail to do so, the accommodation provider is entitled to rent the accommodation to someone else from 18:00 (for one overnight stay) or from 12:00 on the following day (for several overnight stays).
  3. Unless otherwise agreed, the accommodation must be vacated by 10:00 a.m. on the day of departure.

Consumer dispute resolution/universal arbitration centre

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Severability clause

Should any provision of these terms and conditions of guest accommodation be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision.

Place of jurisdiction

The place of fulfilment is the place where the accommodation establishment is located.

If the accommodation contract was concluded with a contractual partner who is a consumer, legal action against the consumer may only be brought at the consumer’s place of residence, habitual abode or place of employment.
